2.1 ELF NV processes, on one hand, personal data that you provide to us, such as:

Electronic identification data: e.g., IP address, via cookies (see cookie policy), etc.; Identification data: e.g., name, email address, address, phone number, birth date, etc.; Professional and/or educational data: e.g., CV, cover letter, education, work history, etc.; Payroll data: e.g., national identification number, marital status, family composition, bank account number, etc. 2.2 Additionally, ELF NV also processes public data. This includes data subject to a publication requirement, such as the publication of your appointment as a director of a company in the Crossroads Bank for Enterprises, or data you have publicly disclosed, such as information on your website, public job sites, or LinkedIn, or data generally known in your area or published in the press, or data found on sources like Graydon.

2.3 ELF NV collects the following categories of personal data:

Contact details: If you use the contact form on this website, you will be asked to provide the following information: name, address, email address, phone number, and personal data you enter in the free-text field (please avoid sensitive information, such as health information, information regarding criminal convictions, or bank account numbers) or other attachment(s) such as CVs. This information is directly provided by you. Usage information: We process personal data concerning your use of our website: IP address, device ID and type, referral source, language settings, browser type, operating system, geographical location, duration of the visit, pages visited, or information regarding the timing, frequency, and pattern of your visit. This information may be aggregated and can help us gather useful information regarding website usage. In case such usage information is anonymized (and therefore not traceable to you as a natural person), it does not fall under this Privacy Policy. This information is automatically collected by your use of the website. 2.4 The legal basis for the use of your personal data is:

Contractual basis: Processing is necessary for the performance of the agreements made in our contract. Consent: We have received explicit and unambiguous consent. You have the right to withdraw your consent at any time. This will not affect the lawfulness of the processing prior to the withdrawal of your consent. Legitimate interest: Processing is necessary for the pursuit of legitimate interests, i.e., supporting our website and improving user-friendliness. Your personal data will only be used for the purposes outlined in Article 3.

Article 3 - Purposes legal basis of processing

3.1 General purposes and legal basis:

ELF NV will use the collected personal data exclusively for the following purposes:

Electronic identification data:

  • Based on the legitimate interests of ELF NV to continuously improve its website and services and ensure the proper functioning and growth of ELF NV. In any case, the legitimate interests of ELF NV will not outweigh your privacy interests. Identification data:
  • To provide you with requested information or services;
  • To offer our services in the best possible manner;
  • To tailor our services and ensure that the right profiles are matched; in this context, we may use profiling and data enrichment techniques;
  • Based on the performance of a contract or your explicit, prior consent. Professional and/or educational data:
  • To assess if you are a suitable candidate for a job vacancy;
  • To contact you whether we have accepted or rejected your application, and to invite you for an interview;
  • To contact you if a relevant position arises in the near future;
  • To offer our services in the best possible manner;
  • To tailor our services and ensure that the right profiles are matched; in this context, we may use profiling and data enrichment techniques;
  • Based on the performance of a contract or on the legitimate interest of ELF NV to inform you about the assessment of your application. Payroll data:
  • For the payment of wages and fringe benefits, holiday pay, or other payments due under the employment contract;
  • Based on the performance of a contract. You are not obliged to provide your personal data, but understand that the provision of certain services becomes impossible if you refuse processing.

Personal data may also be used for direct marketing (e.g., promotions and marketing campaigns related to our services).

Direct marketing related to ELF NV services may be sent to existing customers of ELF NV and its affiliated companies, based on our legitimate interests to ensure the proper functioning and growth of our business. These legitimate interests will not outweigh your privacy interests in any case.

Before sending direct marketing (e.g., promotions and marketing campaigns related to our services) to candidates, temporary workers, and prospects, explicit consent will always be requested.

3.3 Transfer to third parties:

3.3.1 Transfer to third-party service providers

ELF NV may disclose your personal data to third-party service providers providing technical and operational support, and to third-party service providers in general (e.g., lawyers, auditors, etc.) to the extent necessary for professional services and/or if required by law or a court decision.

ELF NV will not sell, rent, distribute, or otherwise commercially make personal data available to third parties, except as described above.

ELF NV is not responsible for how these social media partners use your personal data. In such a case, they will act as data controllers. 

3.3.2 Data transfer within group:

ELF NV is part of the Cronos group, which includes several companies operating in the field of personnel mediation and human resources. ELF NV may share the personal data it processes with other companies within the Cronos group as part of intra-group cooperation and/or intra-group services to improve, facilitate and simplify the activities and services of ELF NV and the Cronos group (e.g. ICT services, accounting, analysis and statistics, debt collection, direct marketing, etc.). In certain cases, ELF NV may act as data controller jointly with other companies of the ELF NV group for the processing of your personal data. This means that they jointly determine the purpose and means of processing your personal data. In this case, they are jointly responsible for compliance with applicable data protection legislation. However, ELF NV remains your main point of contact, including for the exercise of your rights regarding your personal data (for more information on the exercise of your rights, please see Article 5).

ELF NV has 7 subsidiaries (FinSource NV, V-IT NV, Serve 4 Glory NV, Pono NV, SOS Healthcare NV, Sellent NV, Legal Staffing Experts NV) that belong to ELF NV. ELF NV may share the personal data it processes with other companies within the group as part of intra-group cooperation and/or intra-group services to improve, facilitate and simplify the activities and services of ELF NV as a whole (e.g. ICT services, accounting, analysis and statistics, debt collection, direct marketing, etc.). In certain cases, ELF NV may act jointly with other companies of the ELF NV as data controllers for the processing of your personal data. This means that they jointly determine the purpose and means of processing your personal data. In this case, they are jointly responsible for compliance with applicable data protection legislation. However, ELF NV remains your main point of contact, including for the exercise of your rights regarding your personal data (for more information on the exercise of your rights, please see Article 5).

3.4 Transfer to third countries:
No transfer of personal data takes place outside the European Economic Area.

3.5 Legal requirements:
In rare cases, it may happen that ELF NV has to disclose your personal data pursuant to a court order or to comply with other mandatory law or regulations. ELF NV will make reasonable efforts to inform you in advance, unless the legal requirements prevent this.

Article 4 - Duration of processing

The personal data is stored and processed by us for a period that is necessary in line with the purposes of processing as described in Article 3 and in accordance with the contractual relationship between ELF NV and you.

• Electronic identification data, such as IP address: for the duration of your visit to the website;

• Identification data: for the duration of the requested service delivery;

• Candidate data: for the duration of the requested service delivery and employment, in accordance with applicable law; For candidates, both employees and self-employed individuals, we store and process personal data for at least the duration of the selection process. After that, we retain the data for up to 5 years after the last contact, unless a longer period is necessary to achieve the purposes for which they were collected. In the case of a longer term, we will always seek your consent.

• By submitting your CV and/or other personal data via the contact form or email, you agree that your data will be retained and passed on to our affiliated companies for the purpose of finding an opportunity, suitable position, or vacancy. This data will be retained for a maximum period as specified in the cooperation agreement concluded with you, or if we do not find a suitable position for you, for a period of 5 years to potentially contact you in the context of our recruitment reserve, unless you object to this.

• Identification data of the client, customer, or other business relationship: for the duration of the requested service delivery and for compliance with our legal obligations;

• Photos and videos: for the duration of the requested service delivery. Mentioned personal data will in any case be retained in accordance with specific legal requirements, as well as the limitation periods that obligate us to retain your personal data for a longer period, for example, to defend ourselves against a legal claim.

Article 5 - Your rights.

You always have the right to request access, restriction, correction or deletion of your personal data. You have the right to withdraw your consent, object to the processing of personal data or request the transfer of this data. To exercise your rights, please contact us (contact details can be found in Article 9). 

We may ask you to prove your identity to prevent unauthorized access to your data. ELF NV is not always obliged to comply with your request to exercise your rights – your rights only apply in the cases and to the extent provided by law.

Artikel 6 - Safety and confidentiality

We have developed technical and organizational security measures to avoid destruction, loss, forgery, alteration, unauthorized access or accidental disclosure to third parties of collected personal data, as well as any other unauthorized processing of this data. 

To process your personal data, we grant access to our employees. We guarantee a similar level of protection by making contractual obligations – which are similar to this Privacy Statement – enforceable against our employees and staff. Specifically, this means that our employees and staff are bound by confidentiality and that only those who require access to your personal data for the performance of their duties are granted access.

Article 7 - Changes to this Privacy Policy.

We may change this Privacy Policy from time to time. To keep you informed of the latest change to our Privacy Policy, we will update the revision date each time it is changed. The modified Privacy Policy will take effect on that date. Please check this page regularly to stay informed of any changes and/or additions. We will also proactively inform you of any important changes to this Privacy Policy.
